Adsense income need to paid tax?? Seek 2ndopinion!!
Dear Lim
know what you are trying to said. There are many rules interpreted by IRB but not stated clearly in the tax law.Overseas online investment like forex/stock/hyip is tax exempted, even thought it is not taxed on the foreign country. Now some of them want to say adsense and internet incomes are taxable. (some did say no need)See, no rules here, just they interpretation. Any other view?
Dear XXX
Income remittance is no subject to malaysia tax, condition is that u must paid tax in foreign
for example if you work in sg, you declare u tax in sg, and the money remittance to malaysia is tax exempt, prior to that, you need to paid the tax under separate tax agreement.
in adsense or internet income, unless we recognise that is US source, meaning us already deduct our 30% witholding tax before payment (you shall know it you got adsense accounts, normally you choice not deduct ). the problem here , where is source of income? since you not ready to paid us tax( if you already withold the 30% then u are safe).
So you must paid malaysia tax, the content of the malaysia tax guilde not specific mention , wat is the definetely of income.??
The purpose of this amendment is encourage malaysian company toremittance back their profit back to malaysia. and shall not apply to the case like adsense income or other internet income, if you not sure , you can declare under the form BE or form B under income exempted , See the IRD will look for you or not? you then bring this statement to them, see how they response! They will ask the proof of paying tax!!!
look i shall put this into my blogs , hahaha
